Available Standard Contracts The British Marine Federation (BMF) produces a range of standard contracts, which are available for use by members and their clients. These cover the various transactions between customers and member companies. For purchase or sale Contracts are available for the purchase of a new-build boat, a stock boat and the sale or purchase of a second-hand boat, conditional or unconditional There is also a contract for berthing, mooring and storage ashore at marinas or boatyards.
The new-build, or Construction Agreement It is normal to pay the boatbuilder in stages, and under this form of contract the customer always owns that stage of the boat, any accessories and parts that are clearly identifiable for which he has already paid. You should read Schedule II of the contract where all this is clearly defined. If uncertain that payment is due, check with your surveyor, or solicitor. General Terms of Business The BMF has standard Terms of Business for all its members, which are a requirement of most insurance companies, and are the basis upon which members generally do business with their customers. Listing a boat on brokerage The Listing Agreement These are forms for use when placing a boat on brokerage, either with a sole broker, or more than one broker. Dispute resolution In the event of difficulty the BMF recommends some form of alternative dispute resolution before resorting to litigation. In 2007 there will be a scheme of regional mediation which can help resolve many disputes locally in a less combative way. For further details speak to the Company Secretary at BMF.
